Terms of Service — Sukumba

By creating an account and using Sukumba, you agree to these Terms of Service. Please read them carefully. These terms constitute a binding agreement between you ("User") and Sukumba ("we", "us", "our").

1. Acceptance of Terms

By registering for or using Sukumba, you confirm that you are at least 18 years old, have the authority to bind your business to these terms, and agree to comply with all applicable South African laws including the Electronic Communications and Transactions Act (ECT Act) and POPIA.

2. Description of Service

Sukumba is a cloud-based business management platform for trades businesses, providing modules for quoting, job tracking, invoicing, CRM, fleet management, expense tracking, and time attendance. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

3. Your Account

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised access.
  • One account per business. You may not share accounts across unrelated businesses.

4. Acceptable Use

You agree not to:

  • Use Sukumba for any unlawful purpose or in violation of any South African law.
  • Upload malicious code, viruses, or harmful content.
  • Attempt to gain unauthorised access to other users' data or our systems.
  • Reverse engineer, copy, or resell any part of the platform.
  • Use the platform to store or transmit content that is defamatory, discriminatory, or harmful.

5. Data & Privacy

Your use of Sukumba is also governed by our Privacy Policy. You remain the Responsible Party under POPIA for any personal information about your clients, workers, and suppliers that you capture in the platform. You are responsible for obtaining the necessary consent from your data subjects.

6. Subscription & Payment

  • Sukumba offers a 14-day free trial — no credit card required.
  • After the trial, continued use requires a paid subscription.
  • Subscription fees are billed monthly or annually as selected.
  • All prices are in South African Rand (ZAR) and inclusive of VAT where applicable.
  • You may cancel your subscription at any time. No refunds are issued for partial billing periods.

7. Intellectual Property

All content, design, code, and branding of Sukumba remains our exclusive intellectual property. Your business data (quotes, invoices, client records, etc.) remains yours. We do not claim ownership of data you create in the platform.

8. Limitation of Liability

Sukumba is provided "as is". We do not guarantee uninterrupted availability. To the maximum extent permitted by South African law, we shall not be liable for indirect, incidental, or consequential damages arising from your use of the platform, including loss of business or data. Our total liability shall not exceed the subscription fees you paid in the 3 months preceding any claim.

9. Termination

We may suspend or terminate your account if you breach these terms, fail to pay subscription fees, or engage in fraudulent activity. You may terminate your account at any time via Settings → Danger Zone. Upon termination, all your data is permanently deleted.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts. We encourage users to first attempt to resolve disputes by contacting us directly at legal@sukumba.co.za.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of Sukumba after changes constitutes acceptance of the updated terms.
